外国人地方参政権を容認する自治体２２市町

２２市町に外国人住民投票権　自治体の無警戒さ浮き彫りに（産経新聞より）

　市政の重要事項の是非を市民や定住外国人に直接問うと定めた「市民投票条例」の制定を目指す奈良県生駒市のほかに、事実上の外国人地方参政権容認につながる条例を制定している自治体が少なくとも２２あることが８日、産経新聞の調べで分かった。条例をめぐり、外国勢力の動きが見え隠れするケースもあった。国家意識が希薄になる中で、国籍条項を顧みず、なし崩しに走る自治体の無警戒ぶりが浮かぶ。

　一定の要件を満たせば原則議会の議決なしで住民投票を実施できるとした「常設型住民投票条例」は平成１４年９月、愛知県高浜市で初めて制定。投票資格者の年齢を「１８歳以上」と定め、永住外国人にも付与したことで話題となった。

　条例制定はその後広がったが、当初は投票資格などに一定の条件を課すのが一般的だった。ところが、こうした条件はどんどん緩和され、在日米軍基地を抱える神奈川県大和市では制限がないままに１６歳以上の日本人と永住・定住外国人による住民投票を容認する条例が制定されている。

　住民投票条例ではなく、「自治基本条例」で住民投票を定め、規則で永住外国人の投票を容認した東京都三鷹市のようなケースもある。自治基本条例で「市内に住所を有する市民による市民投票」と定めたうえで、「市民とは市内に在住、在勤、在学する者、または公益を目的として市内で活動する者」と「市民」の定義を大幅に広げた埼玉県川口市や、「市長は、住民投票で得た結果を尊重しなければなりません」と住民投票に拘束力があるかのように定めた東京都多摩市のような条例もあった。

　「平成の大合併」と呼ばれた市町村合併の際、永住外国人に「住民投票権」を付与して合併の是非を問うた自治体も多かった。在日本大韓民国民団（民団）による地方議会への働きかけで、永住外国人に投票権を付与するよう条例を改正した埼玉県岩槻市（現さいたま市、条例は合併で失効）や三重県紀伊長島町（現紀北町、同）の例が民団の機関紙「民団新聞」で明らかにされている。
